 PART I PRELIMINARY

  Ordinance may be cited as the Protection of Wages on 
Insolvency
  nance.
  nterpretation
  his Ordinance, unless the context otherwise requires--
  licant" means any person who would, on the winding up of a company,

 PART II PROTECTION OF WAGES ON INSOLVENCY FUND BOARD
  
  stablishment and incorporation of Wages on Insolvency Fund Board
  There is hereby established a board to be known as the Protection 
of
  s on Insolvency Fund Board and in the Chinese language as which 
shall
  body corporate.
  The Board shall consist of a Chairman appointed under the Schedule
and
  more than 10 members appointed by the Governor as follows--
  subject to paragraph (b) not more than 4 public officers;
  equal numbers of persons who, in his opinion, represent employers 
and
  ons who, in his opinion, represent employees.
  The Governor shall give notice of each appointment by notice in 
the
  tte.
  The Schedule shall have effect with respect to the Board.
  unctions and powers of the Board
  The Board shall have the following functions--
  to administer the Fund;
  to make recommendations to the Governor with respect to the 
rate of
  ; and
  to perform such other duties as are imposed or other powers as 
are
  erred on it by this Ordinance.
  The Board may do all such things as are necessary for, or 
incidental
  onducive to, the better carrying out of the functions of the Board
and
  in particular, but without prejudice to the generality 
of the
  going--
  hold, acquire or lease all kinds of property whether 
movable or
  vable;
  sell or otherwise dispose of all kinds of property whether movable 
or
  vable;
  subject to section 10, invest its funds in such manner and to 
such
  nt as it thinks necessary or expedient; and
  with the prior consent of the Financial Secretary, borrow 
money in
  manner and on such securities or terms as it thinks expedient.

 PART III FUND

  e shall be paid from the Fund the following--
  payments to applicants under section 16;
  expenses incurred by the Board for the purposes of this Ordinance;
  capital, interest and charges in respect of any loan; and
  any other sums required or permitted to be paid by the Fund under
this
  nance.
 PART IV FINANCIAL PROVISIONS
  
  inancial year and estimates
  The Board may, from time to time, with the prior approval 
of the
  rnor, fix a period to be the financial year of the Fund.
  In each financial year, before a date to be fixed by the Governor,
the
  d shall submit to the Governor, for his approval, estimates 
of the
  me and expenditure of the Fund for the next financial year:
  ided that the estimates for the first financial year of the Fund
shall
  ubmitted as soon as practicable after the commencement 
of this
  nance.
  The Governor shall consider the estimates submitted to 
him under
  ection (2) and may approve or reject them and, in the 
case of
  ction, may require the Board to resubmit the estimates 
modified in
  manner and within such time as the Governor may direct.
  The Board may, from time to time, vary the estimates approved 
under
  ection (3) and shall, as soon as practicable, deliver to the 
Governor
  atement in writing containing details of any variation.
  ank account
  Board shall open and maintain an account with a bank approved by 
the
  ncial Secretary and shall pay all moneys of the Fund 
into that
  unt.
  Investment of moneys
  moneys of the Fund that are not immediately required by the Board 
may
  
  deposited on fixed term or call deposit or in a savings account
in
  bank licensed under the Banking Ordinance (Cap. 155); or
  with the prior approval of the Financial Secretary, invested in 
such
  r investments as the Board thinks fit.
  Accounts
  Board shall--
  keep and maintain such accounts and records of all transactions
of the
  as the Director of Accounting Services may require; and
  after the end of each financial year cause to be prepared a 
statement
  he accounts of the Fund which shall include an income and 
expenditure
  unt and balance sheet and shall be signed by the Chairman.
  Auditors
  The Board shall at the commencement of each financial year 
appoint
  tors, who shall be entitled to have access to all books of 
account,
  hers and other records kept by the Board and to 
require such
  rmation and explanations as they may think fit.
  The auditors shall audit the statement of accounts prepared 
under
  ion 11 and shall report thereon to the Board.
  Statements and reports to be laid on table of Legislative Council
  The Board shall, within 6 months after the end of each financial 
year

  The Governor shall cause the reports and statements received 
by him

  Costs of administering the Fund
  All costs and expenses incurred by the Government in
administering the
  shall be a charge upon general revenue.
  The Financial Secretary may direct that a supervision fee 
to be
  rmined by him, in relation to such period as may be determined
by him,
  l be charged against the income of the Fund and shall at a 
time
  rmined by him be paid to him by the Board from the Fund and paid 
by
  into general revenue.
 PART V PAYMENT FROM THE FUND
  
  Entitlement to apply for ex gratia payment
  Subject to this Part, an applicant to whom--
  wages are due and unpaid;
  wages in lieu of notice are due and unpaid; or
  the liability to be paid a severance payment has arisen 
and the
  rance payment is unpaid, whether or not the severance payment is 
then
  may apply for an ex gratia payment from the Fund in respect of 
the

may

  An application under subsection (1) (in this Part called an

  No applicant shall apply for payment from the Fund in respect of 
any
  s for services rendered before 1 April 1985.
  No applicant shall apply for payment from the Fund in respect of
wages
  ieu of notice arising out of a contract of employment 
terminated
  re the commencement of the Protection of Wages on Insolvency

  No applicant shall apply for payment from the Fund in respect 
of a

  Payment
  Subject to subsections (1B) and (2) where it appears 
to the
  issioner that an employer has failed to pay any wages, wages in 
lieu
  otice or severance payment, as the case may be, or all or any of 
them
  n applicant and that--
  in the case of an employer who is not a company--
  a bankruptcy petition has been presented against him; or
  he has committed an act of bankruptcy within the meaning of
section 3
  he Bankruptcy Ordinance (Cap. 6) but a petition cannot be 
presented
  nst him by reason of section 6 (1) (a) of that Ordinance; or

  in the case of an employer who is a company, a winding-uppetition

  When the Commissioner makes a payment under subsection (1) (a)

  Where an application has been made in respect of a severance 
payment

Commissioner may
  r consideration of the application until the severance payment

  The Commissioner shall not make any payment under subsection
(1)--
  to the applicant unless the applicant has verified his
application by
  atutory declaration in a form approved by the Commissioner;

  in respect of wages for services rendered more than 4 months prior

  the equivalent of 1 month's wages of the applicant; or

  Subsection (2) (e) (ii) shall not apply to wages in lieu of 
notice

  Review by Board
  Any applicant aggrieved by any decision of the Commissioner 
under
  ion 16 may in writing--
  request the Commissioner to give reasons for that decision; and
  after being given reasons under paragraph  (a), 
request  the
  issioner to refer the application to the Board.
  Upon receiving a request from an applicant under subsection (1) 
(b),
  Commissioner shall forward all documents relating to the 
application
  he Chairman of the Board.
  The Board may confirm or vary any decision of the Commissioner 
on an
  ication referred to it under this section or may for those 
purposes
  ire the Commissioner to make further inquiries relating 
to the
  ication.
  Additional power of Commissioner
  Notwithstanding that in any particular case a petition referred
to in
  ion 16 (1) (a) (i) or (b) has not been presented against an 
employer,
  Commissioner may, subject to subsection (2) of that section, 
make an
  ratia payment under that section in that case if in his opinion--
  nded, 41 of 1988 s. 3)
  the employer employs less than 20 employees;
  sufficient evidence exists to support the presentation of a 
petition
  hat case on the ground--
  if the employer is a company, that he is unable to pay his debts;
or
  if the employer is a person other than a company, that 
he has
  itted an act of bankruptcy; and
  it is unreasonable or uneconomic to present a petition in that
case.
  Where the Commissioner exercises his discretion under 
subsection (1)
  ake payment, he shall give notice in the Gazette stating that,
in his
  ion, sufficient evidence exists to support the 
presentation of a
  tion on the ground--
  if the employer is a company, that he is unable to pay his debts;
or
  if the employer is a person other than a company, that 
he has
  itted an act of bankruptcy.
  Nothing in subsection (2) shall require the Commissioner to give 
more
  one notice in respect of each employer.
  No action shall lie against the Commissioner in respect of any 
notice
  n under subsection (2).
  
  Verification of application
  For the purpose of verifying any application under section 15, 
or if
  equired by the Board under section 17 (3), the Commissioner may

各有关单位:

  为促进上海现代物流产业的发展,加速现代物流人才队伍能力建设,全面、科学、客观、公正地对现代物流人员的知识积累、能力水平和业绩表现进行评价,根据《上海市人事局关于印发<上海市专业技术水平认证暂行规定>的通知》(沪人〔2004〕66号),本市实行现代物流人员专业技术水平认证。现将《上海市现代物流专业技术水平认证暂行办法》印发给你们,请遵照执行。

  本通知的有关内容,在上海人事人才网(http://www.21cnhr.gov.cn,http://rsj.sh.gov.cn)和上海市职业能力考试院网站(http://www.spta.gov.cn/)上可供下载。

上海市现代物流专业技术水平认证暂行办法


  第一条为推动上海物流中心建设,促进上海现代物流产业的发展,提升物流人才的专业能力和业务水平,加速现代物流人才队伍能力建设,特制定本暂行办法。

  第二条本办法适用于具备供应、装卸、运输、配送、仓储、库存、信息等基础知识,并在本市相关机构中从事物流实务操作、技术支持、营销服务、发展规划和项目管理等工作的人员,以及有志于从事现代物流及相关工作的人员。

  第三条上海市现代物流专业技术水平认证由上海市职业能力考试院负责组织实施。

  第四条上海市现代物流专业技术水平认证实行统一标准、统一组织、统一颁证。

  上海市现代物流专业技术水平认证采用考试、评审、鉴定、测评或认可等方式进行。

  第五条上海市现代物流专业技术水平认证分初级、中级和高级三个级别。

  初级:了解现代物流管理的相关基础知识,能熟练进行相关的计算机操作,主要承担现代物流实际的基层工作和操作事务。

  中级:具有较丰富的现代物流专业理论基础及实践经验,熟悉国家和本市有关的法律法规,能熟练使用专业软件,在现代物流中能全面履行项目经理的职责。

  高级:掌握国内外现代物流产业的现状和发展趋势,具有深厚的理论功底和丰富的实战经验,了解国际规则和国际惯例,熟悉有关法律法规和技术、管理、服务标准,能在现代物流中负责宏观决策、战略管理、策划营销、经营运作、诊断咨询等工作。

  第六条凡热爱现代物流事业,遵守国家有关法律、法规和本市相关规定,且具备下列第七条、第八条或第九条条件者,均可以报名参加相应级别的上海市现代物流专业技术水平认证考试。

  第七条申请参加上海市现代物流专业技术水平认证(初级)的人员,除具备第六条所列的基本条件外,还需具有中等职业教育毕业以上学历。

  第八条申请参加上海市现代物流专业技术水平认证(中级)的人员,除具备第六条所列的基本条件外,还需具备下列条件之一:

  (1)获得博士学位;

  (2)获得硕士学位或第二学士学位后,从事物流及相关工作满1年;

  (3)大学本科毕业后,从事物流及相关工作满3年;

  (4)大学专科毕业后,从事物流及相关工作满5年,或取得现代物流初级证书后,从事物流及相关工作满3年;

  (5)具有中级职称。

  第九条申请参加上海市现代物流专业技术水平认证(高级)的人员,除具备第六条所列的基本条件外,还需具备下列条件之一:

  (1)获得博士学位后,从事物流及相关工作满2年;

  (2)获得硕士学位或第二学士学位后,从事物流及相关工作满7年,或取得现代物流中级证书后,从事物流及相关工作满5年;

  (3)大学本科毕业后,从事物流及相关工作满6年,或取得现代物流中级证书后,从事物流及相关工作满5年;

  (4)具有高级职称。

  第十条参加上海市现代物流专业技术水平认证考试合格的人员,由上海市职业能力考试院统一颁发《上海市专业技术水平认证证书》。

  第十一条本办法由上海市职业能力考试院负责解释。

  第十二条本办法自2004年8月15日起施行。

  《宁波市节约能源条例》已报经浙江省第十一届人民代表大会常务委员会第十五次会议于2009年12月30日批准,现予公布,自2010年3月1日起施行。

  第一章 总 则

  第一条 为推动全社会节约能源,提高能源利用效率,保护和改善环境,建设资源节约型、环境友好型社会,促进经济社会全面协调可持续发展,根据《中华人民共和国节约能源法》和其他有关法律、法规,结合本市实际,制定本条例。

  第二条 本条例适用于本市行政区域内节约能源(以下简称节能)及其相关的管理活动。

  第三条 节能工作遵循政府引导、市场运作、技术推进和全社会参与的原则,坚持节能与发展相互促进、节能与开发并举。

  第四条 市和县(市)区人民政府应当加强节能工作,实行有利于节能和环境保护的产业政策,调整优化产业结构、企业结构、产品结构和能源消费结构,合理、有效地利用能源,推动企业降低单位产值能耗和单位产品能耗,避免能源浪费。

  市和县(市)区人民政府应当将节能工作纳入本地区国民经济和社会发展规划、年度计划,并组织编制和实施节能中长期专项规划、年度节能计划。节能中长期专项规划和年度节能计划,应当包括工业节能、建筑节能、交通运输节能、公共机构节能、重点用能单位节能、生活节能等内容。

  市和县(市)区人民政府应当每年向本级人民代表大会或其常务委员会报告节能工作。

  第五条 依法实行节能目标责任制和节能考核评价制度。

  市人民政府应当每年对县(市)区人民政府、市有关部门和重点用能单位落实节能目标责任制情况进行考核,并公布考核结果。

  第六条 市和县(市)区节能行政主管部门负责对节能工作的综合协调和监督管理。节能行政主管部门可以委托节能监察机构从事节能方面的日常监督检查工作。

  工业、建设、交通、农业、旅游、商贸、城市管理等部门和机关事务管理机构按照各自职责,负责相关领域的节能监督管理工作。

  发展与改革、统计、财政、质量技术监督、科技、环保、规划等部门按照各自职责,协同做好节能工作。

  第七条 鼓励和支持节能科学技术的研究、开发、示范和推广,促进节能技术创新与进步。

  鼓励和支持开发利用新能源、可再生能源。

  第八条 市和县(市)区人民政府及其相关部门、乡镇人民政府和街道办事处、能源生产经营单位应当加强节能宣传,普及节能知识,增强全民的节能意识。

  重点用能单位应当对本单位职工开展节能教育和培训。

  中小学校、高等院校应当组织节能知识宣传教育,开展节能实践活动。

  村(居)民委员会应当运用多种形式普及节能知识,指导家庭节能,倡导节能环保的生活方式。

  新闻媒体应当开展节能宣传报道,发挥舆论引导和监督作用。

  第九条 鼓励和支持行业协会以及节能产品设计、生产、销售单位,推广节能产品,指导用户正确使用节能产品,引导节能型消费。

  第十条 任何单位和个人都应当依法履行节能义务,有权检举浪费能源的行为。

  第二章 节能管理

  第十一条 依法实行固定资产投资项目节能评估和审查制度。对年综合耗能超过国家和省、市规定限额的新建、改建、扩建和更新改造的固定资产投资项目,应当进行节能评估和审查。未经节能评估和审查的项目以及不符合强制性节能标准的项目,投资主管部门不得批准或者核准建设。

  第十二条 禁止生产、进口、销售国家明令淘汰或者不符合强制性能源效率标准的用能产品、设备;禁止使用国家明令淘汰的用能设备、生产工艺。

  对国家规定有淘汰期限的用能产品、设备、生产工艺,市节能行政主管部门应当会同相关部门制定淘汰计划,指导用能单位实施淘汰或者技术改造。

  第十三条 本市已有一定规模或特色的产业,尚无有关节能的国家标准、行业标准和地方标准的,市节能行政主管部门可以会同市标准化行政主管部门制定指导性节能技术规范,指导用能单位开展节能工作。

  鼓励企业制定严于国家标准、行业标准和地方标准的企业节能标准,采用国际先进节能标准。鼓励企业参与国家、行业和地方节能标准的制定。

  第十四条 生产过程中耗能高的产品的生产单位,应当执行国家和省规定的单位产品能耗限额标准。对超过单位产品能耗限额标准的生产单位,节能行政主管部门应当责令其限期治理。

  对高耗能的特种设备,依法实行节能审查和监管。

  第十五条 市统计部门应当会同市节能行政主管部门、发展与改革部门,定期向社会公布单位地区生产总值能耗、电耗,规模以上工业增加值能耗、电耗,县(市)区以及主要耗能行业的能源消费和节能情况等信息。

  第十六条 市节能行政主管部门应当会同相关部门建立节能信息服务平台,及时公布节能政策、节能标准,定期发布节能新产品、新技术等信息,为社会提供节能指导和服务。

  第十七条 鼓励行业协会在行业节能规划、行业节能标准制定和实施、行业节能技术推广、节能宣传培训、信息咨询等方面发挥作用。

  鼓励行业协会以行业内能耗先进水平的量化指标为基准,推动协会成员调整用能结构、加快节能技术改造、强化节能管理,提高能源利用效率。

  第十八条 鼓励和支持节能服务机构开展节能咨询、设计、评估、检测、审计、认证、培训、推广等服务,承担有关节能方面的服务外包。

  节能服务机构应当遵守职业道德,公正、客观地为委托单位提供服务。

  第三章 合理用能

  第十九条 节能行政主管部门应当加强对重点用能单位节能的监督管理,每年公布本级监管的重点用能单位名单。

  第二十条 重点用能单位应当建立健全节能管理组织体系,设立能源管理岗位和能源计量岗位,确定能源管理负责人和能源计量人员。  

  重点用能单位应当制定年度节能计划,采取节能措施,提高能源利用效率,控制能源消耗总量,开展能源消耗定额管理和对标管理,落实节能目标责任制。

  重点用能单位应当每年向节能行政主管部门报送上一年度的能源利用状况报告。重点用能单位未实现上一年度节能目标的,应当在能源利用状况报告中说明原因。

  第二十一条 节能行政主管部门和相关部门在监督管理中发现重点用能单位有下列情形之一的,应当开展现场调查,委托节能服务机构实施用能设备能源效率检测,责令实施能源审计,并提出书面整改要求,限期整改:

  (一)无正当理由,未实现上年度节能目标的;

  (二)能源计量数据、统计数据有明显错误的;

  (三)能源利用效率低于同行业平均水平的;

  (四)节能管理制度不健全、节能措施不落实、能源利用效率低的其他情形。

  节能行政主管部门应当对重点用能单位实行一定周期循环的电平衡测试和热效率测试制度。

  第二十二条 电力、钢铁、石油加工、化工、造纸、有色金属、化纤、印染、建材等主要耗能行业应当实施节能工程。

  鼓励工业企业采用高效、节能的电动机、锅炉、窑炉、风机、泵类等设备,采用热电联产、余热余压利用、凝结水利用以及先进的用能监测和控制等技术。

  第二十三条 规划行政主管部门在编制城市详细规划时,应当按照建筑节能的要求,确定建筑物的布局、形状、朝向。

  建设行政主管部门在施工图设计文件审查备案、核发施工许可证和工程项目竣工验收备案时,应当对建设工程执行建筑节能标准情况进行监督检查。

  第二十四条 市建设行政主管部门应当会同有关部门根据建筑节能规划,组织制定既有建筑节能改造计划,明确节能改造的目标、范围和要求,报经市人民政府批准后实施。

  市和县(市)区人民政府应当采取鼓励措施推进既有建筑节能改造计划的实施及可再生能源的建筑应用。

  第二十五条 建筑工程应当按照规定使用新型墙体材料,鼓励采用其他节能型建筑材料和设备、可再生能源。

  对具备可再生能源利用条件的民用建筑,建设单位应当选择合适的可再生能源,用于采暖、制冷、照明和热水供应等。

  具备可再生能源利用条件的政府投融资的建筑项目及新建建筑面积二万平方米以上的大型商场、酒店、医院,应当至少利用一种可再生能源。

  可再生能源利用设施应当与建筑主体工程同步设计、同步施工、同步验收。

  第二十六条 房地产开发企业在销售商品房时,应当向购买人明示所售商品房的能源消耗指标、节能措施和保护、围护结构保温隔热性能指标、保温工程保修期等信息,并在商品房买卖合同和住宅质量保证书、住宅使用说明书中载明。

  商品房业主或非业主使用人应当按照住宅使用说明书的要求使用房屋,不得在装修时损坏住宅保温层等节能设施。

  第二十七条 市和县(市)区人民政府应当加大对公共交通的投入和扶持,完善公共交通基本网络,引导和鼓励市民选乘公共交通工具出行,减少交通能源消耗。

  第二十八条 鼓励使用低耗能、低污染的节能环保型汽车和清洁能源汽车。鼓励新能源在城市公交、建设工程和环卫特种车辆等方面的应用和推广。

  第二十九条 公共机构应当建立节能组织管理体系,实施能源消耗定额管理,加强能源消费计量和监测管理,优先采购列入节能产品、设备政府采购名录中的产品、设备,禁止采购国家明令淘汰的用能产品、设备。

  机关事务管理机构应当会同同级有关部门,按照管理权限,根据公共机构能源消耗综合水平和特点,制定能源消耗定额,财政部门根据能源消耗定额制定能源消耗支出标准。

  第三十条 公共机构应当对既有的办公建筑、空调、照明、电梯、锅炉等进行节能改造。

  第三十一条 公用设施和大型建筑物管理者应当使用高效节能照明灯具,按照规定启闭景观照明,严格控制景观照明能耗。

  公共建筑管理者应当严格执行国家和省、市有关空调室内温度控制的规定,充分利用自然通风,改进空调运行管理。

  第四章 节能技术进步与节能激励措施

  第三十二条 鼓励和支持开发应用太阳能、风能、地热能、生物质能、潮汐能等新能源和可再生能源。

  第三十三条 市和县(市)区人民政府应当安排节能专项资金,支持节能项目研发、节能技术和产品的示范与推广、重点节能工程和可再生能源开发利用项目的实施、节能宣传培训、信息服务和表彰奖励等。

  节能专项资金应当适应节能工作的需要,根据经济发展水平逐步提高。

  第三十四条 市和县(市)区人民政府及其相关部门应当把节能技术研究开发作为政府科技工作的重点领域,公布节能技术、节能产品的推广目录,支持企业、科研单位和高等院校研发通用性、关键性节能技术和设备,促进节能技术的成果转化和应用推广。

  第三十五条 企业开发节能新技术、进口节能研发用品、购置节能专用设备,依法享受税收优惠。

  第三十六条 鼓励金融机构加大对节能领域的信贷投入,拓展节能服务机构、企业节能项目的筹资渠道,降低筹资成本。

  鼓励政策性银行和商业银行通过联合贷款、转贷款等合作方式,为起步资金大、投资回报期长的节能项目提供全程金融服务。

  推动和引导社会有关方面加大对节能的资金投入。

  第三十七条 市和县(市)区人民政府应当运用市场机制推动节能工作开展,逐步实行有利于节能的能源差别价格政策。

  第三十八条 推广合同能源管理模式,鼓励节能服务机构和其他有关单位为用能单位实施节能改造提供服务。

  推行电力需求侧管理,鼓励用能单位定期组织开展电力需求侧管理潜力调查,制定年度负荷管理目标、节电目标和实施方案。

  鼓励电力企业与用户运用协议避峰等措施限制高峰期电荷,合理调整用电负荷。

  第三十九条 市和县(市)区人民政府对在节能管理、节能科学技术研究和推广应用中有显著成绩以及检举严重浪费能源行为的单位和个人,给予表彰和奖励。

  第五章 法律责任

  第四十条 违反本条例,《中华人民共和国节约能源法》和其他相关法律、法规已有处理规定的,依照其规定处理。

  第四十一条 违反本条例第二十条第一款规定,重点用能单位未设立能源计量岗位、确定能源计量人员的,由质量技术监督部门责令限期改正;逾期不改正的,处一万元以上三万元以下罚款。

  第四十二条 违反本条例第二十一条规定,重点用能单位拒不配合实施能源审计、电平衡测试或热效率测试的,由节能行政主管部门责令其限期改正;逾期不改正的,处二千元以上二万元以下罚款。

  第四十三条 违反本条例第二十五条第三款、第四款规定,具备可再生能源利用条件的政府投融资的建筑项目及新建建筑面积二万平方米以上的大型商场、酒店、医院未利用可再生能源或可再生能源利用设施未与建筑主体工程同步设计、同步施工、同步验收的,由建设行政主管部门责令建设单位限期整改;逾期未整改的,责令停止建设,并处二十万元以上五十万元以下的罚款,整改后,方能交付使用。

  第四十四条 违反本条例第二十六条第二款规定,商品房业主或非业主使用人未按照住宅使用说明书的要求使用房屋,在装修时损坏住宅保温层等节能设施的,由建设行政主管部门责令其限期改正。

  第四十五条 违反本条例第二十九条第一款规定,公共机构采购用能产品、设备,未优先采购列入节能产品、设备政府采购名录中的产品、设备,或者采购国家明令淘汰的用能产品、设备的,由政府采购监督管理部门给予警告,并可处一万元以上五万元以下罚款;对直接负责的主管人员和其他直接责任人员依法给予处分,并予通报。

  第四十六条 违反本条例第三十一条第二款规定,公共建筑室内空调温度设置不符合规定的,由节能行政主管部门责令改正。

  第四十七条 节能行政主管部门和其他有关部门及其工作人员违反本条例,在节能管理工作中滥用职权、玩忽职守、徇私舞弊的,由有权机关责令改正,对直接负责的主管人员和其他直接责任人员,依法给予行政处分;构成犯罪的,依法追究刑事责任。

  第六章 附 则

  第四十八条 本条例相关用语含义如下:

  (一)能源审计,是指受委托的节能服务机构依据国家有关的节能法规和标准,以规定的程序和方法对企业和其他用能单位能源利用的物理过程和财务过程进行的检验、核查和分析评价,以促进节能、制止浪费,提高能源利用率和经济效益。

  (二)合同能源管理,是一种基于市场运作的以减少的能源费用来支付节能项目全部成本的节能投资方式,即由节能服务机构提供资金、技术和全过程服务,在客户配合下实施节能项目,在合同期间与客户按照约定的比例分享节能收益的节能机制。

  (三)电力需求侧管理,是指通过提高终端用电效率和优化用电方式,在完成同样用电功能的同时减少电量消耗和电力需求,达到节能和保护环境,实现低成本电力服务所进行的用电管理活动。

  第四十九条 本条例自2010年3月1日起施行。
